RELEASE AND ACKNOWLEDGMENT OF RISK

• I understand and acknowledge that the activity to be engaged in through my rental of any equipment brings with it both known and unanticipated risks to myself, guests and others. Those risks include but are not limited to falling, slipping, crashing and colliding which could cause injury, illness, disease, death, and/or property damage to my guests, myself or others.
• I voluntarily release, indemnify, hold harmless and discharge Jump and Slide, Inc. (hereinafter referred to as JSI ) for any and all liability claims, demands, actions or rights of action, whether personal to me, or a third Party, which are related to, arise out of or are in any way connected with my rental from JSI including those allegedly attributed to negligent acts or omissions. I agree to reimburse any reasonable attorney’s fees and costs which may be incurred by JSI in any defense of any such liability claim, demand, action or right of action.
• In the event, I file a lawsuit against JSI, I agree to do so solely in the state where the JSI office is located, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state.
• I acknowledge that I have adequate homeowners, tenant or other liability insurance to cover any injuries or property damage which might occur to myself, guests or others while using the equipment rented from JSI.
• I acknowledge that I am responsible for the safe keeping of the rental equipment while in my possession. In the event of damage to (other than normal wear and tear) or loss of the equipment occurs while in my possession, I will reimburse JSI for replacement or repair. Possession is defined as prior to being picked up by the JSI employee. Only the JSI manager can approve leaving any equipment unattended.
• I have read the rules supplied by JSI regarding the use of the rental equipment and agree to follow these rules without exception.
• I acknowledge and certify that I have had sufficient time to read this entire agreement, understand the content and freely execute it without duress. I agree to be bound by the terms of this agreement.
